Terms of Agreement for all ONLINE AND IN-PERSON EDUCATION W/DESHAWN HATCHER INSTRUCTOR
INCREASE YOUR SPEED (IYS) is an individualized, one-on-one private training, in-person hands-on session. The focus of IYS is to develop your speed, enhance time management skills and improve proper client interactions. Please note: Increase Your Speed is not a beauty class.

PAYMENT/FEES
As consideration for any purchase, you make on the Websites, you shall pay DESHAWN HATCHER, all applicable fees, and taxes. We (or our third-party payment processor) shall authorize your credit card, bank account, or other approved payment facility you provided during the registration process for the full payment of the fees and any applicable taxes, and you hereby consent to the same. If the mailing address you provided us is in the United States, all payments will be charged and made in U.S. dollars. If the mailing address you provided us is outside the United States or any of its possessions or territories, all payments will be charged and made in your local currency.
Non-Refundable CLAUSE
Buyer understands that once the purchase price has been delivered and the securities issued, there is no rescission of this agreement, and no refund will be made. (Please see transfer clause)
PAID IN FULL AND INSTALLMENT PLANS
You hereby authorize DeShawn Hatcher to obtain or determine updated or replacement expiration dates for your credit card in the event that the credit card you provided us expires. We reserve the right to charge any renewal card issued to you to the same extent as the expired card. If payment is not received from your credit card issuer, you hereby agree to pay all amounts due upon demand. You agree to pay all costs of collection, including attorney’s fees and costs, on any outstanding balance. In certain instances, the issuer of your credit card may charge you a foreign transaction fee or related charges, which you will be responsible to pay. You are advised to check with your bank and credit card issuer for details.
INJURY/LIABILITY/HOLD HARMLESS CLAUSE
You agree you will not hold DeShawn Hatcher, or The Lofts at Beacon liable for any injury or harm you may sustain while on property. You will not hold them liable for any damages that may be sustained to your vehicle. I will not hold DeShawn Hatcher liable for any injury I may cause to my model while working on my assignments in person or online.
YOUR KIT
You are required to bring a full working kit. If your kit is not clean, you will be required to disinfect/sanitize before the start of training. That time will be deducted from the overall time of your session. DeShawn Hatcher is not responsible for providing makeup kits.
The Pandemic Clause/Government Shutdown
In the event of a pandemic or Government Shutdown DeShawn Hatcher will reschedule the training when the government deems it safe to go back to work. The sessions are never canceled and will go on with a rescheduled date at your convenience and DeShawn Hatcher's schedule. You have one year from the date the government reopens to reschedule a class previously paid for and reapply for the new course. Anything after one year, you will relinquish your training date and payment. You will have to rebook and pay for new training.

The session will be following NYS/Government Covid/medical guidelines. Please be sure to bring masks with you and proper PPE. Gloves, masks, hand sanitizers, and face shields

Covid Test must be taken, and a positive outcome is needed to take this training (subject to state guidelines)
MEALS
All meals will be provided, and every opportunity to provide food with your diet will be considered. Any food allergies DeShawn Hatcher must be made aware of. Online courses you will be responsible for your meals
SMOKING
This is a non-smoking building Smoking isn't allowed
RESCHEDULE CLAUSE
As a courtesy, once you have paid in full, you can reschedule the date you have selected one (1) time up to a year from the original date of the training. DeShawn must be notified no less than 2 weeks in advance of your original date for rescheduling. Your new training date will be rescheduled at the convenience of DeShawn Hatcher’s agenda. There is no guarantee the class will be available in the future. Please note: You will be billed a model fee of $150 for all in-person classes. Upon the scheduled agreement between DeShawn Hatcher and the student, all fees must be paid in full before the student can take the training.
MODEL FEE/REBOOKING
As soon as you are booked a model will be secured for your training session. If you cancel/change the date of training a new model fee of $150 will be charged to your credit card on file upon rebooking.

Note: Your model, can be any ethnicity or age. (If you have a model, you’d like to bring they must contact DeShawn Hatcher and they will have to be accepted This does not waive the model fee.

WRITTEN MATERIALS/IMAGES/VIDEOS are copyright protected
Copyright DeShawn Hatcher 2023/2024 All materials, including but not limited to text, images, videos, and any other content created by DeShawn Hatcher and provided in this class are protected by copyright law. These materials are intended for the educational use of students enrolled in classes and may not be reproduced, distributed, or used for any other purpose without prior written permission from DeShawn Hatcher. Unauthorized use or distribution of these materials may result in legal action.
Students are granted a limited, non-exclusive license to use these materials for the duration of the course, solely for educational purposes. This license does not extend beyond the end of the course. Any other use, including but not limited to commercial use, distribution outside the course, or modification of the materials, is strictly prohibited.

TRANSFER CLAUSE
Due to the nature of this training, this is non-refundable. However, this training is transferable. Transferable meaning, you are responsible to find a replacement to take your place, not DeShawn Hatcher. Payment must be exchanged between you and the agreed replacement, not with DeShawn Hatcher. Your replacement must contact DeShawn Hatcher, immediately to confirm training attendance and/or reschedule within 2 weeks of the scheduled session or you forfeit the total cost of the session.
Unless DeShawn Hatcher is notified and has approved, admittance will not be allowed to your replacement. You have one year (from the date booked) to find a replacement.
*Please note new dates may be accommodated but aren’t guaranteed due to DeShawn’s scheduling.
*DeShawn will work with your replacement on a date beneficial to both parties and once agreed upon cannot be changed
*The “replacement” must go to the website and fill out the register before they can be accepted.
*They must follow all the rules of the terms of agreement.
TERMINATION OF AGREEMENT
In the event DeShawn Hatcher cannot perform the duties of the instructor, a replacement date will be issued at the student’s agreeance and convenience If DeShawn Hatcher cannot complete the training, a full refund will be given to the student. DeShawn Hatcher reserves the right, in her sole discretion, to restrict, suspend, or terminate this Agreement at any time and for any reason without prior notice or liability
Lateness Policy
All education provided by DeShawn Hatcher has set start and end times you agree upon signing the training. However, if you are late, the schedule will be adjusted, and you may not receive a full training. DeShawn will do all she can to provide you with maximum education but cannot guarantee a full training curriculum due to lateness
No Guarantee of Success
It is impossible to provide any promise or guarantee about the outcome of IYS. Nothing in this Agreement or any statements by DeShawn Hatcher constitute a promise or guarantee. If you do not practice your lessons, there is no way you will master this training. If after the session you are not understanding or succeeding, please use your (2) follow-up progress reports with DeShawn Hatcher so she can address and answer your concerns
